1. Acceptance of Terms
By accessing or using Swaadi's website (swaadi.in) or the Swaadi application (collectively, "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use our Platform. These Terms constitute a legally binding agreement between you ("User") and Swaadi ("Company", "we", "us").
2. Description of Service
Swaadi is a technology platform that connects users with local home kitchens and food businesses for daily tiffin (meal) subscription and delivery services. We facilitate:
- Browsing and selecting from verified local kitchen menus
- Placing single or recurring tiffin orders (lunch, dinner, or both)
- Subscribing to monthly meal plans at discounted rates
- Managing a digital wallet for convenient payments
- Real-time order tracking and delivery management
3. User Accounts
- You must be at least 18 years old to create an account and use the Service.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, current, and complete information during registration.
- You must notify us immediately of any unauthorized use of your account at swaadi.dev@gmail.com.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Orders and Subscriptions
4.1 Order Placement
Orders must be placed before the kitchen's cutoff time (typically 10:30 AM for lunch and 6:00 PM for dinner). Orders placed after the cutoff time will be scheduled for the next applicable delivery slot.
4.2 Subscriptions
Subscriptions are charged monthly in advance. By subscribing, you authorize Swaadi to deduct the applicable amount from your wallet or initiate payment via the selected payment method. Subscriptions do not automatically renew unless explicitly opted in.
4.3 Customization
Meal customizations (e.g., extra roti, no rice) are subject to kitchen availability and may incur additional charges. We cannot guarantee all customizations will be accommodated.
5. Pricing and Payments
- All prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
- We accept payments via Swaadi Wallet, UPI, debit/credit cards, and net banking through Razorpay.
- Cash on Delivery (COD) is available for individual tiffin orders as per kitchen policy.
- Wallet top-ups are non-refundable except as per our Refund Policy.
- Prices are subject to change with prior notice. Existing subscriptions will honor the price at the time of subscription until renewal.
6. Delivery Policy
- Delivery is available within our serviceable areas in Chandigarh Tricity (Chandigarh, Mohali, Panchkula).
- Estimated delivery times are provided as a guide and may vary due to traffic, weather, or other factors.
- If you are unavailable at the time of delivery, the delivery partner will attempt to contact you. After 2 failed attempts, the order may be marked as delivered.
- Swaadi is not liable for delays caused by circumstances beyond our control (force majeure).
7. Cancellations
Please refer to our Refund & Cancellation Policy for complete details. In summary:
- Individual orders can be cancelled before the kitchen begins preparation (before cutoff time).
- Subscriptions can be cancelled at any time; prorated refunds are issued for unused days.
- Orders already dispatched for delivery cannot be cancelled.
8. Food Safety and Quality
While we verify and onboard kitchen partners based on hygiene standards, Swaadi acts as a marketplace platform. Kitchen partners are independent businesses responsible for the quality, hygiene, and safety of the food they prepare. Swaadi is not directly liable for food quality issues but will facilitate dispute resolution between users and kitchen partners. In case of a genuine food quality complaint, please contact us within 2 hours of delivery with photographic evidence.
9. Intellectual Property
All content on the Swaadi Platform including logos, trademarks, text, graphics, images, and software is the exclusive property of Swaadi or its licensors and is protected by Indian intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Swaadi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the specific order or service giving rise to the claim in the preceding 30 days.
11. Governing Law
These Terms shall be governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Chandigarh, India. Disputes will first be attempted to be resolved through mutual negotiation and mediation before litigation.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 7 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
